The legal position

Since the abolition of default retirement age (Employment Equality (Repeal of Retirement Age Provisions) Regulations 2011), UK retirement is treated as any other resignation. Contractual notice applies. The employer cannot force retirement at 65 or any other age without objective justification (rare).

Notice for retirement

The contractual notice period is the legal minimum:

  • Standard employee: 1-3 months.
  • Senior manager: 3-6 months.
  • Executive: 6-12 months.

Best practice for retirement is significantly more - typically 3-6 months even for short-notice contracts. This allows employer succession planning, pension crystallisation, handover and reference building.

Pension timing

Retirement usually coincides with drawing pension. Steps:

  1. Confirm State Pension Age (from GOV.UK).
  2. Contact all workplace pension providers 6-12 months before target retirement.
  3. Request pension quotes for target retirement date.
  4. Consider tax-free lump sum options.
  5. Take FCA-regulated pension advice for defined benefit or complex arrangements.
  6. Coordinate resignation date with pension crystallisation date.

Phased retirement

Phased retirement reduces working hours before full retirement. Options:

  • Flexible working request under section 80F ERA (day-one right since 2024).
  • Job share.
  • Part-time hours.
  • Consultancy or contractor arrangement after formal retirement.
  • Trustee, non-executive or advisory role.

Pension access rules

UK pension access:

  • Private pension: from age 55 (rising to 57 from April 2028).
  • State Pension: 66 currently, rising to 67 by 2028, 68 by 2039.
  • NHS Pension: varies by scheme membership (1995, 2008, 2015).
  • Public sector pensions: normal pension age varies by scheme.

Retirement letter

Retirement resignation letters can be warmer than standard resignations. Suitable content:

  • Formal statement of retirement resignation.
  • Final working day (calculated from contractual notice).
  • Brief acknowledgement of the years worked.
  • Offer of handover support.
  • Warm sign-off.

Retirement handovers are typically longer and more comprehensive than standard exits:

  • Extended documentation of processes and client relationships.
  • Introduction of successors to key contacts.
  • Written knowledge transfer.
  • Trainee mentoring.
