The headline rule
Band 8b is mid-tier senior leadership across clinical and operational service. The common contractual notice in trust policies is three months (or 12 weeks) on both sides, and some senior contracts set a longer figure individually. The NHS Terms and Conditions of Service (Agenda for Change) Handbook does not set notice periods by band, so check the figure in your own contract.
The same figure usually applies whether you are resigning or being made redundant. The UK statutory minimum under section 86 of the Employment Rights Act 1996 sits underneath as a floor: one week from you once you have worked one month, and from the trust one week per full year of service (at least one week, up to 12 weeks). Where the statute gives more than the contract, the statutory figure applies.
Worked example dates
Three months from the date the trust receives your written resignation:
- Resignation on 6 January → final working day 5 April.
- Resignation on 28 February → final working day 27 May.
- Resignation on 31 March → final working day 30 June.
- Resignation on 15 October → final working day 14 January (following year).
These example dates count notice as ending the day before the matching date, which is how many trust HR teams count it. Our calculators treat the day you hand in notice as day zero, so they show the matching date instead (resign on 12 March with one month’s notice and the calculator shows 12 April). Ask HR which way your trust counts, and get the agreed last day in writing.
The NHS notice period calculator handles the arithmetic and the weekend or bank holiday rollback for any start date. The general notice period calculator and final working day calculator do the same with extra options.
Roles typically at Band 8b
Heads of professional service (lead allied health professional for a directorate), senior consultant nurses with cross-trust scope, deputy directors of clinical service, lead chief biomedical scientists, senior public health consultants, senior clinical psychologists with departmental leadership.
The three months notice is the same across all Band 8b roles. The job description determines the band, not the underlying profession.
Notice during Band 8b probation
The standard NHS probation period is six months. During probation, notice is shorter on both sides, typically one month, rising to the full three months once probation is signed off.
For the broader detail on how NHS probation works, see NHS probation period and the practical NHS probation guide.
Handing in notice
A written resignation letter to your line manager, copied to HR, alongside the formal ESR (Electronic Staff Record) entry. State the resignation, name the role, give the final working day, offer to support a handover. The resignation letter generator builds a tailored letter from a few fields. The resignation letter templates include an NHS-appropriate example.
The full sequence from handing in notice through to your last day is on the NHS resignation guide.
What happens during the notice period
Your contractual obligations continue in full. You turn up for shifts and documentation. You remain bound by confidentiality and (where applicable) professional standards. Pay, pension contributions, and benefits run as normal until the final working day.
Annual leave accrued during the leave year can be taken during notice or paid out in the final pay packet. The holiday entitlement calculator pro-rates the accrued figure.
Garden leave and PILON
Garden leave clauses are more common at Band 8b/8c than at lower tiers because of the competitive sensitivity of the roles. Where the clause exists, the trust can require you to stay at home on full pay for some or all of the notice. PILON is more common at this tier than at lower ones, particularly in redundancy and senior-management exits.
For the detail, see garden leave explained, PILON explained and the PILON calculator.
Negotiating a shorter notice
The three months figure is occasionally shortened by mutual agreement. The usual triggers: a new employer needs you sooner, a personal circumstance change, a service reorganisation. Approach via your line manager and HR; any agreed shorter date is recorded in writing as a variation to the contractual notice.
There is no contractual right to a shorter notice; it is at the trust’s discretion. For the broader UK rules on early exits, see can I leave before my notice ends?
What Band 8b notice is worth in 2026/27
Band 8b has three pay points: £66,582 on entry, £70,896 after 2 years and £77,368 after a further 3 years, subject to the pay progression process. These are the Agenda for Change rates for England from 1 April 2026. The table shows the gross basic pay that falls within the typical Band 8b notice of 3 months, worked out as annual pay divided by 12 for each month.
| Pay point | Annual pay | Gross pay for 3 months |
|---|---|---|
| Entry | £66,582 | £16,645.50 |
| Intermediate | £70,896 | £17,724.00 |
| Top | £77,368 | £19,342.00 |
Why this matters: if you work your notice, this is roughly the basic pay still to come before your final payslip. If the trust pays you in lieu of notice instead, basic pay for the notice period is the usual starting point for the payment, and it is taxed through payroll like salary. For example, at the top of Band 8b (£77,368), 3 months of basic pay is £19,342.00 before tax, National Insurance and pension contributions. The PILON calculator works through the tax side.
The figures leave out High Cost Area Supplements (London and the fringe zones), unsocial-hours enhancements and on-call pay, which your contract may or may not include in notice pay. Frequently asked questions
- What is the notice period for an NHS Band 8b?
- Usually three months, but your contract decides. The NHS Terms and Conditions of Service (Agenda for Change) Handbook does not set notice periods by band; each trust sets notice in its contracts and local policy, and three months is the common figure for Band 8b (12 weeks at some trusts; some senior contracts set longer). The same figure usually applies whether you are resigning or being made redundant. Whatever your contract says, the legal minimum applies: one week from you once you have worked one month, and from the trust one week per full year of service (at least one week, up to 12 weeks).
- How do I work out my Band 8b final working day?
- Count three calendar months from the date your line manager receives the written resignation. If you resign on 12 March, your final working day is 11 June. The NHS Notice Period Calculator handles the date arithmetic for any start date including weekend and bank holiday rollback.
- What is the notice during Band 8b probation?
- Typically one month during probation, rising to three months once probation is signed off. The shorter probation notice is deliberate and applies on both sides. The exact figure is in your individual contract and your trust's policy.
- Can the trust hold me to a longer notice than my contract says?
- No. The contractual notice in your contract is the maximum the trust can require. They can ask informally for longer to help with cover, but you are entitled to leave at the contractual end point. The exception is where you have signed a separate variation extending the notice.
- What are the typical Band 8b roles?
- Heads of professional service (lead allied health professional for a directorate), senior consultant nurses with cross-trust scope, deputy directors of clinical service, lead chief biomedical scientists, senior public health consultants, senior clinical psychologists with departmental leadership. The notice is the same across all Band 8b roles regardless of the underlying profession. The job description determines the band, not the profession.
